    Federal Constitutional Court Issues Comprehensive Rules for Cross-Border Child Custody Cases

    In a landmark judicial interpretation which is set to change the face of private international law in Pakistan, the Federal Constitutional Court (FCC) has laid down specific and rigorous guidelines governing child custody cases involving transnational parents. The three-member bench led by Chief Justice Aminuddin Khan, which included Justice Ali Baquer Najafi and Justice Rozi Khan Bareech, ruled that domestic courts should uphold international courts with utmost respect so as to avoid cross-border child abductions. The lengthy eight page verdict sets a precedent for future multi-jurisdictional family cases.

    Overturning the SHC Order: The Mechanics of the Case

    That was the landmark decision by Justice Ali Baquer Najafi which scrapped a previous order passed by the Sindh High Court (SHC) granting temporary custody to the mother. The case was a highly contentious one between Muhammad Faraz Sheikh of North Carolina (USA) and Jaweria Shahani. 

    Their child, Rohan, was born a citizen of the United States. Following an interim joint custody order issued by a competent US court, the mother unilaterally flew the child to Karachi without the father’s knowledge or consent, subsequently filing a local guardianship suit. The FCC ruled that because both parents had already submitted themselves to a foreign court of competent jurisdiction, parallel litigation or conflicting orders could not be legally sustained in Pakistan.

    The Hague Convention 1980 and the Principle of ‘Habitual Residence’

    The FCC extensively integrated international legal treaty benchmarks into its guidelines, specifically invoking the spirit of the Hague Convention 1980 on the Civil Aspects of International Child Abduction.

    The court codified several critical judicial limits:

    Habitual Residence Priority: The removal or retention of a child from their country of “habitual residence” is a breach of custody rights under international understandings.

    The Prompt Return Mandate: Unless it is demonstrated that a child is fully settled into a new environment or faces a grave risk of physical or psychological harm upon return, the child must be repatriated promptly to their original jurisdiction.

    Jurisdictional Restraints on Local Courts: Once a domestic guardian court is notified of a wrongful cross-border removal, it must pause evaluating the substantive merits of custody until the legality of the child’s return is fully settled.

    Statutory Standards for Recognizing Foreign Judgments

    The Federal Constitutional Court further clarified the explicit conditions under which family and guardian courts in Pakistan are legally bound to recognize and enforce foreign decrees. According to the new guidelines, an overseas custody ruling is valid if it was rendered by a court of competent jurisdiction, decided strictly on its merits, and is not visibly contrary to Pakistan’s local public policies or international human rights statutes.

    By implementing these strict parameters for cross-border child custody, the FCC has mandated that lower courts move away from purely emotional or localized assumptions. Instead, they must prioritize international comity and the definitive best interests of the child. This development will significantly reduce legal deadlock for overseas Pakistani families while anchoring Pakistan’s judicial system within global human rights frameworks.
