    FCC Bars Registered Doctors from Operating Unlicensed Medical Stores

    The Federal Constitutional Court (FCC) in a landmark ruling for national infrastructure for healthcare has decided that a registered medical practitioner may not run a medical store or medical retail without a valid license. The extensive ruling by the apex court takes the legacy dispensaries adjacent to clinics which could not be monitored and converts them into a highly regulated system-vetted statutory regime. The clinical authority of the doctors is upheld in the apex court ruling which states that doctors are not barred from entering the parallel commercial pharmacy business even if they have not obtained independent regulatory approval as long as they prescribe and dispense medicine to their patients.

By overriding a legacy June 2023 stay order issued by the Peshawar High Court’s D.I. Khan bench the FCC reinstates absolute administrative power to provincial health departments.     According to the certified judicial order authored by the constitutional panel the intersection of practitioner exemptions and commercial drug commercialization is governed by distinct legal parameters that prevent administrative conflation.

    The Prescriptive Limitation Clause: Section 31(4)(a) of the Pharmacy Act exempts doctors from liability when they dispense medicine specifically to meet their own prescription for their direct patients.

    The Clinical Exemption of the Commercial Ingestion Barrier: The bench sided with the practitioners and found that the clinical exemption under the Drugs Act 1976 does not allow doctors to carry the stock, market and distribute a wide range of inventory retail lines through an unlicensed facility.

    The Absolute Licensing Directive: To ensure market predictability the judgment requires that under Section 23(1)(c) of the Drugs Act anyone conducting commercial drug sales would have to obtain a formal retail licence independently.
